New Supreme Court Roster Allows Top Five Judges To Hear PIL Matters

Chief Justice of India Ranjan Gogoi has notified a new roster of work which said top five judges of the apex court will be hearing Public Interest Litigation (PIL) matters.

  • According to the fresh roster uploaded on the apex court website, the CJI will deal with the PIL matters and it would be his discretion to assign PIL cases to other top four judges — S.A. Bobde, N.V. Ramana, Arun Mishra, and R.F. Nariman.
  • This is reversing a year-old protocol by which such cases were restricted only to the Chief Justice’s court.
    • The subject wise roster was introduced by former CJI Dipak Misra in February 2018, in the backdrop of master of roster controversy which erupted after the press conference of four senior judges, who allege CJI selectively assigning cases to the bench of preferences, ignoring seniority of Judges.
  • According to experts, the Supreme Court roster was not public and the procedure for hearing PILs varied with chief justices, the Master of the roster.
    • There were no clear criteria governing PILs
  • Traditionally, in the Supreme Court and high courts, PILs are heard by the courts of the chief justices. This was so because the number of PILs filed were small in numbers. But with time, the number of PILs in the apex court increased and Chief Justices decided how to deal with them.
